Temporary Exemption for Half-Pricing of Retail Motor Fuel Dispensers |
You may qualify for a temporary exemption from computing the full price of motor fuels sold at retail under Agriculture and Markets Regulations Section 224.6(d). The exemption is only available to those stations that meet certain criteria:
The station must use mechanical price computing equipment (similar to the picture) that is not capable of computing the total price at the full price per gallon.
The current selling price exceeds the price computation capability of the equipment.
Reasonable efforts have been made to purchase the necessary equipment to comply with the regulations.

If you qualify, please complete one form of the application as indicated below. Instructions are on the form along with the text of the regulation. You may apply on-line using the link below or you may download either the Word or PDF version of the form and submit it via email, FAX or regular mail as directed on the form.
By submitting the form you will be certifying that you qualify for the exemption and that you agree to comply with the provisions of the half-pricing rules. Once your application is accepted you will be sent a formal exemption and you must comply with the following while using half-pricing at your station.

- The station must modify each face of each pump to show that the price per gallon is one-half the price per gallon.
- The station must modify each face of each pump to show that the total sale amount is one-half the total sale.
- In (2) and (3) above the term one half shall be expressed either as “1/2” or “one-half” in one inch high letters that are clear, legible, and conspicuous with respect to color, style and contrasting background. It is the station’s responsibility to maintain those markings.
- The station must continue to post “pump topper” signs disclosing the full price per gallon of the motor fuel in conformance with Section 192 of the Agriculture and Markets Law. Please note that amendments were made in the law since these regulations were promulgated that permit 6 inch x 6 inch signs for some styles of gas pumps notwithstanding the section 224.6(d)(4) of the regulation. These smaller signs are deemed acceptable while using half-pricing. Those signs shall agree with corresponding road side advertisement.
